Shipping Terms & Conditions

Please read these terms and conditions ("Terms") carefully. These terms and conditions constitute a legally binding agreement between the "Company" and the "Customer". "Company" shall mean Cradlewise Inc.("We" or "Us" and their connotations) and "Customer" shall mean the individual or entity for which the Company is rendering its services.

Terms & Conditions

  • The timeline for shipment is dictated by the options you choose at the time of making a purchase and the options available here are dictated by stock availability. The price of the crib decreases incrementally the further out the delivery month is from the time of placing the order, for up to a maximum of 6 months.
  • We do not charge for standard ground forward shipping. You may be charged a Reverse shipping fee for returns. Please see our Return Policy for more details.
  • The product is shipped only to the original purchaser of genuine Cradlewise product(s) purchased from https://cradlewise.com (Authorized website).
  • Purchase from a third-party website will not be validated
  • The purchase will be validated and shipped only to customers in the contiguous United States, Australia, Canada and India
  • We do not currently ship to the following U.S. territories or States; Alaska, Hawaii, American Samoa, Guam, Marshall Islands, Northern Mariana Islands, Palau, Puerto Rico, and U.S. Virgin Islands.
  • We do not currently ship to the following Canada territories or States; Yukon Territory, the Northwest Territories and the Nunavut Territory
  • Additionally, we do not ship to PO Box addresses. If you are unsure if we service your address, please get in touch with customer service.
  • Please retain the original box/package of your Cradlewise Smart Crib. You'll need to re-pack the unit in case of returns and claiming a warranty.
  • These terms and conditions are in addition to the Standard Conditions of Terms of Services, Warranty, and Return policies.
  • Cradlewise, Inc. reserves the right to make changes to this policy at any time without notice.

International Shipping Limitations

  • 1. Each item in your order is sold by https://cradlewise.com (Authorized website). When ordering from https://cradlewise.com (Authorized website), the recipient is the importer of record and must comply with all laws and regulations of the destination country.
  • Cradlewise currently ships within the contiguous United States, Australia, Canada and India. Please note the following guidelines:

    • United States Store: Orders placed through the US store will only ship within the contiguous United States.
    • Canada Store: Orders placed through the Canada store will only ship within Canada.
    • India Store: Orders placed through the India store will only ship within India
    • Australia Store: Orders placed through the Australia store will only ship within Australia
    • Cradlewise does not offer international shipping outside of these regions.

      3. Import Fees for International Shipping:

    • Cradlewise does not ship internationally. However, if products are forwarded outside the US, Australia, Canada or India through a third party, those items may be subject to taxes, customs duties, and fees levied by the destination country ("Import Fees").

      4. Importer's Responsibility:

    • The recipient of the shipment is the importer of record in the destination country and is responsible for all Import Fees, the clearance of merchandise, and the process and remittance of the actual Import Fees for such items.

      5. Obtaining Import Fee Details:

    • For details regarding the actual Import Fees or to obtain documentation or receipts related to customs clearance, you may contact the designated freight forwarders specified in your shipment confirmation.
  • 6. For products used outside the country of original shipment by the Company (i.e., outside the contiguous United States, Australia Canada or India), any manufacturer's warranty will be void. If the product is damaged during transit to an international location, we will not be able to replace or service the product under any circumstances.
  • 7. Cradlewise 60 Nights Trial Policy will not be applicable for orders that are taken outside of the contiguous United States, Australia, Canada or India.
  • 8. Manufacturer service options (Mobile Applications) may not be available.
  • 9. Product manuals, Instructions, and Safety Warnings may not be in the destination country's languages.
  • 10. The products (and accompanying materials) may not be designed in accordance with the Standards, Specifications, and Labeling requirements of the destination country.
  • 11. You are responsible for ensuring the product can be lawfully imported to the destination country.

Privacy

Your privacy is important to us, and we know that you care about how information about your order is used and shared. We would like customers shipping products internationally to be aware that cross-border shipments are subject to opening and inspection by customs and/or postal authorities. Authorities also require the value of the product to be stated directly on the package.

Package Protection Terms & Conditions

  • SERVICE OVERVIEW
    • Package Protection Service: Cradlewise offers optional Package Protection through our licensed insurance partner to protect your order against loss, damage, or theft during shipping. This service is OPTIONAL and not required to complete your purchase.
    • Coverage Period: Protection begins when your order leaves our fulfillment center and ends upon successful delivery confirmation to the address you provided.
    • Territory: Coverage is available exclusively for shipments within the Contiguous United States (48 contiguous states). Alaska, Hawaii, U.S. territories, APO/FPO addresses, and international shipments are not eligible.
  • WHAT'S COVERED
    • Standard Coverage Includes:
      • Loss during transit - Package never arrives or goes missing during shipping
      • Theft after delivery - Package stolen after carrier delivery confirmation
      • Shipping damage - Physical damage to product or packaging during transit
    • Coverage Value:
      • Full order value including product cost, shipping fees, and applicable taxes
      • No deductible for approved claims
      • Replacement product or full refund at our discretion
  • WHAT'S NOT COVERED
    • Customer-Related Exclusions:
      • Incorrect delivery addresses provided by purchaser
      • Refusal of delivery or unavailability for delivery attempts
      • Customer-authorized delivery to unsecured locations
    • Product-Related Exclusions:
      • Normal wear and tear or cosmetic imperfections not affecting function
      • Issues from product installation, assembly, or setup
      • Products subject to active safety recalls
    • Force Majeure Events:
      • Acts of God (earthquakes, floods, hurricanes, etc.)
      • Wars, terrorism, civil unrest, government actions
      • Pandemic restrictions or quarantine measures
      • Infrastructure failures, cyber attacks, or labor strikes
      • Extreme weather beyond normal seasonal expectations
  • HOW TO FILE A CLAIM
    • Filing Timeline:
      • Damage claims: 3 days from delivery date
      • Loss claims: 10 days from ship date
      • Theft claims: 3 days from delivery confirmation
    • Required Information:
      • Order Details: Order confirmation number, tracking information, shipping address & email id used for placing the order
      • For Damages: Photo Documentation:
        • Six-sided exterior package photos (clear, high resolution)
        • Close-up of shipping label with readable tracking number
        • Interior packing before unpacking
        • Damaged items in original packaging context
        • Multiple angles of damage areas
        • All packing materials and their condition
      • For Theft Claims: Police report if required
      • Written Description: Detailed explanation of damage or loss
    • How to File:

      • Subject Line: "Package Protection Claim - Order #[NUMBER]"
      • Include: All required documentation listed above
  • CLAIMS PROCESSING
    • Timeline:
      • Claim Acknowledgment: Within 48 hours of filing
      • Initial Review: 5-10 business days for standard claims
      • Resolution Decision: Within 15 business days of complete documentation
      • Payment/Replacement: Will be issued on standard shipping date of Cradlewise
    • Resolution Options:
      • Identical product replacement shipped at 23rd of the every month
      • Full refund
  • PRICING AND PAYMENT
    • Payment:
      • One-time fee added at checkout
      • No recurring charges or additional fees
      • Refundable if order is cancelled before shipment
  • YOUR RIGHTS AND RESPONSIBILITIES
    • Your Rights:
      • Transparent claims process with regular status updates
      • Right to dispute claim denials through provider's appeals process
      • Access to claim documentation and correspondence
      • Right to opt out of arbitration (see Section 9)
    • Your Responsibilities:
      • Provide accurate delivery address
      • File claims within specified timeframes
      • Provide complete and accurate documentation
      • Cooperate with claims investigation process
      • Notify us of address changes before tracking information is sent
  • DISPUTE RESOLUTION
    • Informal Resolution:Contact Cradlewise Customer Service first at support@cradlewise.com to attempt good faith resolution of any disputes.
    • Binding Arbitration: Unresolved disputes will be settled through binding arbitration administered by the American Arbitration Association under Consumer Arbitration Rules, conducted in your home state.
    • Opt-Out Right: You may opt out of arbitration by sending written notice to 40087 Mission Blvd, #391 Fremont, CA 94539 within 30 days of purchase. This does not affect your Package Protection coverage.
    • Class Action Waiver: You agree to resolve disputes individually and waive rights to participate in class action lawsuits, except where prohibited by law.
  • IMPORTANT SAFETY NOTICE
    • Baby Product Safety: Package Protection covers only shipping-related issues and does not provide health, safety, or performance guarantees. All products meet Consumer Product Safety Improvement Act (CPSIA) requirements at shipment.
    • Your Responsibility: You remain responsible for monitoring product recalls, ensuring proper installation per manufacturer guidelines, and following all safety instructions.
    • Recall Coverage: Coverage may be void for products subject to safety recalls unless you were not notified of recall status before purchase.
  • DATA PRIVACY
    • Information Collection: We collect only information necessary to process claims, including order details, delivery information, and claim documentation.
    • Information Sharing: Customer information is shared with insurance provider and necessary service providers only for Package Protection services.
    • Your Privacy Rights: You have rights to access, correct, or delete personal information subject to legal record-keeping requirements.
    • Security: All data is protected using industry-standard encryption and security protocols.
  • GENERAL TERMS
    • Service Changes: We reserve the right to modify these terms with 30 days notice. Changes will not affect existing coverage purchased before the effective date.
    • Governing Law: These terms are governed by the laws of California and applicable federal laws.
    • Severability: If any provision is found unenforceable, the remaining provisions remain in full force and effect.
    • Entire Agreement: These terms, along with your order confirmation and insurance provider terms, constitute the complete agreement regarding Package Protection services.
